San Diego's new transit housing law: what should homebuyers inspect?

On July 1, 2026, the zoning map for a significant portion of San Diego County quietly rewrote itself. Senate Bill 79, signed by Governor Newsom in October 2025, allows buildings up to 8 stories tall directly adjacent to qualifying trolley stations, 6 stories within a quarter-mile, and 5 stories within a half-mile. The law overrides local zoning restrictions and applies to properties near the Blue, Orange, Green, and Copper Line trolley stops across San Diego, La Mesa, El Cajon, Santee, and other jurisdictions.


That empty lot next to the ranch house you're looking at near the SDSU Transit Center? It can now become an 8-story residential building without requiring the traditional community approval process. The single-family neighborhood a few blocks from the Old Town station? Five-story multifamily is now permitted on commercially zoned parcels. The City of San Diego adopted a phasing ordinance on May 21, 2026, that exempts some areas temporarily (Low Resource Areas delayed until 2031, Very High Fire Hazard Severity Zones, historic sites, and areas subject to sea-level rise), but for the 74 qualifying transit stops that SANDAG identified in June 2026, the new rules are live.


If you're buying a home anywhere near a San Diego trolley station right now, your inspection needs to account for things that didn't matter six months ago. The physical condition of the house is still the foundation of the inspection. But the context around it has changed, and that context affects what you're actually buying.


First question: is the property in an SB 79 zone?


Before anything else, figure out whether the home you're considering falls within the SB 79 radius. The law applies to parcels within a half-mile (as the crow flies) of a qualifying transit-oriented development stop, but the City of San Diego measures eligibility using a one-mile walking distance exemption and has created a specific SB 79 Eligible Sites layer in its Zoning and Permit Portal (ZAPP) that shows exactly which parcels are affected.


This matters because SB 79 doesn't just affect the property you're buying. It affects every eligible parcel around it. The single-story commercial building next door, the surface parking lot across the street, the vacant lot at the corner. Each one is now potentially a site for multifamily construction at heights that would have been unthinkable under the previous zoning. Understanding what can be built around you is as important as understanding what you're buying.


Check the ZAPP layer. Check the adjacent parcels. And check whether the area has implemented SB 79 immediately or is in a phased category (Low Resource Areas, fire zones, historic overlays, coastal exemptions) where implementation is delayed.


Acoustic and noise evaluation: this just became critical


Here's the inspection angle that most buyers aren't thinking about yet. Transit-oriented development zones are, by definition, next to transit. Trolley lines produce noise. Bus routes produce noise. The higher-density development that SB 79 encourages will increase traffic, construction activity, and ambient sound levels in neighborhoods that were previously quiet.


If you're buying near a trolley station, the home's acoustic performance is no longer a nice-to-have. It's a functional consideration that affects daily livability.


Windows are the weak point. Glass transmits sound far more readily than solid walls. Single-pane windows (common in San Diego homes built before the 1980s) offer minimal noise reduction. Dual-pane windows perform better, and sound-rated windows (with an STC rating of 35 or higher) perform significantly better. But even good windows fail acoustically when their seals are broken.

During the inspection, we check the pane count (single vs. dual), seal condition around every frame, weatherstripping integrity, and whether windows close and latch tightly enough to create an acoustic seal. Broken seals on dual-pane windows (visible as fogging between the panes) reduce both thermal and acoustic performance.


Wall insulation matters for sound, not just temperature. The type of insulation in the exterior walls affects how much noise penetrates. Standard fiberglass batt provides some noise reduction, but denser materials (cellulose, mineral wool) dampen sound more effectively. Most buyers don't think to ask about insulation type, but in a transit zone, it's relevant information.


Vibration is the one nobody talks about. Trolley lines, bus routes, and nearby construction activity produce vibrations that travel through the ground and into the structure. Over time, repeated vibration can contribute to hairline cracking in drywall and stucco, particularly at stress concentration points (window corners, door frames, ceiling-to-wall joints). During the inspection, we document existing cracking patterns so you have a baseline. If a developer starts pile-driving next door in 18 months, you'll want photographic evidence of what was there before the construction began.


Infrastructure capacity: will the old systems handle the new density?


This is the sleeper issue that's going to catch buyers off guard over the next several years. SB 79 allows dramatically increased density on parcels served by infrastructure that was designed for single-family or low-density use. The trolley can handle more riders. But can the sewer main handle more toilets? Can the water supply maintain pressure when a 6-story building with 75 units connects to the same line that serves your house?


Sewer lateral condition. We've been recommending sewer scope inspections for older homes in San Diego for years because of cast iron deterioration. In SB 79 zones, the sewer scope takes on an additional dimension. If a large development project connects to the same sewer main that serves your property, the additional volume puts more demand on a system that may already be at capacity. Cracks, root intrusion, or bellies in your sewer lateral become more consequential when the overall system is handling more flow. A scope reveals the current condition so you know what you're working with before the density increases.


Electrical panel capacity. We check panel capacity on every inspection, but in transit zones the future use of the property matters. A 100-amp panel is adequate for a basic single-family home. But if you want to add an EV charger (likely, if you're near transit and environmentally conscious), convert the garage to an ADU (now easier under California law), or add any other significant electrical load, a 100-amp panel won't support it. A 200-amp panel gives you room to grow. If the home has a 100-amp panel, factor the upgrade cost into your budget.


Water pressure. We test water pressure on every inspection. In transit zones, it's worth paying attention to the reading. As surrounding density increases, localized pressure drops during peak usage are possible, particularly in areas where the water infrastructure hasn't been upgraded to match the new zoning capacity. A solid pressure reading today doesn't guarantee the same reading in three years, but it establishes a baseline.


What can be built next door: the context inspection


This isn't something a home inspector evaluates (it's a zoning and planning question, not a physical condition question), but it's something every buyer in an SB 79 zone needs to investigate alongside the inspection.


Check adjacent parcels. Look up the parcels immediately surrounding the property on the City's ZAPP system. Are they eligible for SB 79 development? What's currently on them? A surface parking lot or a single-story commercial building on an SB 79-eligible parcel is a likely development candidate. If an 8-story building goes up on an adjacent lot, your views, privacy, sunlight, and parking situation change dramatically.


Understand the timeline. SB 79 didn't immediately turn every eligible lot into a construction site. Development takes time: acquisition, design, entitlement, financing, and construction. But the trajectory is clear. The most desirable parcels near the busiest trolley stations will see development interest first. The College Area near SDSU, the stations along the Orange Line through La Mesa and El Cajon, and the stops along University Avenue in North Park and City Heights are among the areas where activity is most likely in the near term.


Retaining walls and grading near property lines. If an adjacent lot gets developed and the developer excavates for an underground parking garage or deep foundation, the construction can affect soil stability on your property. During the inspection, we document the condition of retaining walls, grading, and foundation elements near property lines. This baseline documentation is valuable if construction-related damage occurs later.


Foundation baseline: document everything now


This point deserves its own section because it's the most forward-looking piece of the inspection in an SB 79 zone.


When a developer constructs a large building on an adjacent lot, the excavation, pile-driving, and heavy equipment operation can transmit vibrations and cause soil movement that affects neighboring properties. Cracks that appear in your foundation, drywall, or stucco after construction begins on the lot next door may be the developer's liability, but only if you can demonstrate that the cracks weren't there before.


A thorough inspection with detailed photographs of the foundation, exterior walls, stucco condition, and interior finish conditions creates a timestamped record of the home's condition before any adjacent construction begins. This documentation is your evidence if you ever need to pursue a construction-damage claim.


We photograph foundation walls, exterior stucco (especially at corners and around openings), interior drywall at stress points, and any existing cracks or conditions. The report becomes your "before" snapshot.


The HOA and condo angle


If you're buying a condo or townhome in an SB 79 zone (rather than a single-family home), additional considerations apply.


The building's HOA documents should be reviewed for any discussions about neighboring development projects that could affect the building (construction noise, view impacts, shared infrastructure). The reserve study should reflect anticipated maintenance costs, and the master insurance policy should be current. If the building has exterior elevated elements (balconies, walkways), SB 79 doesn't change the SB 326 inspection requirements, but the increased density around the building makes maintenance of these elements more important.


For newly built condos in transit zones, construction quality evaluation is the primary inspection focus. New construction can have its own set of issues: flashing installation, waterproofing, plumbing connections, and finish quality that hasn't been tested by time or weather yet.
